Terms of Service

The Earnyway Terms of Service are composed of the following agreements:

User Agreement

This is important: This User Agreement (“Agreement”) contains important information about your legal rights, remedies, and obligations, and is a legally binding agreement between you (“you” or “User”) and Earnyway. (“Earnyway,” “we”, or “us”), Earnyway. (“Earnyway”), and to the extent expressly stated, Earnyway (“Earnyway.”), governing your use of Earnyway's Site and Site Services (collectively, “Services”). You understand that by using the Earnyway Site or Site Services (which generally means using in any way our Remote Job Platform earnyway.com or our applications), and by clicking accept when prompted On the site, you agree to be bound by all agreements that constitute Earnyway’s Terms of Service , and you agree that the “Terms of Service” means every agreement linked herein and includes the Fee and ACH Authorization Agreement, Privacy Policy, Terms of Use, applicable Escrow Instructions, and this User Agreement, including Section 14, which contains an arbitration agreement and class action waiver that apply to claims brought against Earnyway in the United States. You have an opportunity to opt out of arbitration, as provided in Section 14. You should read all of our terms carefully. because you are promising not to break any agreements in the Terms of Service.

If you want to use our Remote Job Platform or any of our services (which we refer to altogether as services), whether just by looking around or registering an account, you must first read and agree to this Agreement (including the dispute resolution and arbitration provisions in Section 14). If you don’t understand this Agreement or don’t agree to all of its terms and conditions, you may not use our services. If you do not understand or agree to this Agreement, Do not click to accept this Agreement, “Sign Up”, “Create My Account”, or similar, and do not visit earnyway.com, use our web applications, or otherwise use our services. If you are using our services on behalf of a business or legal entity, You may only do so if you have the authority to agree to the Terms of Service on behalf of that business or legal entity. To make these terms a little easier to understand, we capitalize certain terms, and capitalizing them means they have a special meaning. Section 13 provides the definitions of some capitalized terms, and others are defined throughout. the Terms of Service (look for quotation marks and bold font).

1. User Agreement

1.1 Registration:

You must register for an account to have full access to our Services, and your registration is subject to our approval. You must register for an account with us (“Account”) to access and use certain portions of our Services. Registered users of our Services are “Users”, and unregistered users are “Site Visitors”.


Your Account registration is subject to approval by Earnyway. We reserve the right to decline a registration either to join Earnyway or to add an Account of any type, for any lawful reason, including supply and demand, cost to maintain data, or other business considerations.

1.2 Account Eligibility:

You promise to use our Services for business purposes only. You also promise that you are eligible to enter into this Agreement, including because you are 18 years or older.


Earnyway offers the Services for your business purposes only and not for personal or consumer use. By registering for an Account or by using our Services, you represent that you: (a) are doing business under your name as a self-employed individual/sole proprietor or are an employee or agent of an independent business (such as a corporation, limited liability company, or other entity); (b) will use our Services for business purposes only; (c) will comply with any licensing, registration, or other requirements concerning your business, or the business for which you are acting, and any offering or provision of Remotejob Services; and (d) are either a legal entity or an individual who is at least 18 years old (or the age of majority in your country if the age of majority is over 18), and that you can form legally binding contracts.

1.3 Account Profile:

You must provide accurate personal information when you sign up and you must update your account if your personal information changes. We can suspend or terminate your account if the information you give us is false, outdated, or incomplete.


To register for an Account to use our Services, you must complete a User profile (“Profile”), which you consent to be shown to other Users and, unless you change your privacy settings, to be shown to the public. You agree to provide accurate and complete information on your Profile—and on all registration and other forms you access while using our Services or provide to us—and you agree to keep that information current. You agree not to provide any false or misleading information about your identity or location, your business, the beneficial owner(s) of your business, your skills, or the services your business provides, and you agree to correct any information that is or becomes false or misleading. We reserve the right to suspend or terminate the Account, or access to our Services, of anyone who provides false, inaccurate, or incomplete information in creating, marketing, or maintaining a Profile or an Account.

1.4 Identity and Location Verification:

When you register for an Account and periodically thereafter, your Account will be subject to verification, including but not limited to validation against third-party databases or the verification of one or more official government or legal documents that confirm your identity, your location, and your ability to act on behalf of your business on Earnyway. You authorize Earnyway, directly or through third parties, to make any inquiries necessary to validate your identity, your location, and confirm your ownership of your business, email address, or financial accounts, subject to applicable law. When requested, you must timely provide us with complete information about yourself and your business, which includes providing official government or legal documents and cooperating with other reasonable requests we make to verify your identity. During verification, some Account features may be temporarily limited but will be restored if verification is completed.

1.5 Usernames and Passwords:

You will keep your username and password secret and will not share them, and you will not use anyone else’s username and password.


Each person who uses our Services must register for their Account with a username and password. You are responsible for safeguarding and maintaining the confidentiality of your username and password and agree not to share your username or password with anyone. You are responsible for safeguarding your username and password and for any use of our Services with your username and password. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your Account or any unauthorized access to your password. You further agree not to use the Account or log in with the username and password of another User.

This document explains the rules that keep our Remote Job Platform running.

We call these rules our Terms of Use. They apply to earnyway.com and all the websites and web apps we own or run. (And by we, we mean Earnyway, which we may also refer to as us.) These terms explain how we expect you to behave when you’re using Earnyway – whether you’re a registered user or an unregistered site visitor on our site.

1. About licences and User content

Here we’ve included the conditions for using our site, which we do our best to keep running smoothly.

1.1 We let you use our site and services

Technically, we’re giving you a ‘limited license’ to the site. Here’s what that means. We’re happy for you to access our website and services (known as the services). You’re free to have this access (or limited license) as long as you follow these terms of use and all of our other Terms of Service as they apply to you.


We’ll do our best to make sure our services are safe and working as they should, but we can’t guarantee you’ll have access continuously. We might even stop providing certain features or services completely and don’t have to give notice if we do.

1.2 We can stop you from using our site and services

We can take away your right to use our services at any time. If you violate our Terms of Use or other parts of our Terms of Service, we can take away your access to Earnyway.


Officially, this is called terminating your license, and if it happens, we’ll tell you that you must stop using our services immediately.

1.3 We keep the rights to our intellectual property

Using our services doesn’t mean you can use any of our trademarks or other intellectual property, like copyrights and patents. We keep all of our rights to our intellectual property, even though we let you use our services. Our logos and names are our trademarks and are registered in certain jurisdictions. Any other product or company names, logos, or similar marks and symbols you see on Earnyway may be trademarked by our partners or other users like you.

2. What you’re allowed to do on Earnyway

Our services are for work and learning, not personal use. We facilitate business connections, and payments, and provide useful information. However, we don't guarantee the accuracy of the information and it should not be used as legal or tax advice. Always verify the information independently.

3. What you’re not allowed to do on Earnyway

3.1 We cannot accept invalid information

If There seems to be a problem with your data. Please review and try again.

3.2 Double-check your email address.

Take a moment to review your email address and ensure all characters are typed correctly.

3.3 Data should be submitted based on specific keywords.

Categorise your submissions using keywords that accurately reflect the content. This helps others find the information they need quickly.

3.4 Make sure to provide screenshots correctly.

Attach screenshots to strengthen your submission if they provide valuable visual context. Ensure they are clear and fully relevant to the information you're presenting.

3.5 The information for the seller and the manufacturer should not be mixed.

Separate information about the seller who offers the product from the manufacturer who creates it. This improves data clarity and avoids confusion.

Privacy Policy

This Privacy Policy explains how and why Earnyway collects, uses, and shares personal information when interacting with or using our Site or Service. It also includes any information Earnyway collects offline in connection with the Service, which we may combine with information from the Site and Service. By reading this Privacy Policy, you will understand your privacy rights and choices.

When we say “Earnyway”, we mean Earnyway ., and any of its affiliates, including Earnyway Payments, When we say “Site”, we mean www.earnyway.com, and when we say “Service”, we mean the Site plus any websites, features, applications, widgets, or online services owned or controlled by Earnyway and that post a link to this Privacy Policy.

As part of the Service, Earnyway provides a remote job that results in platform information about different parties to an interaction. Users of the Service may be Clients, Remote Workers, or Site Visitors (as each is defined in the User Agreement). This Privacy Policy applies to Earnyway’s processing of the personal information of Users where Earnyway determines the purposes and means of processing. It does not apply to the processing of information by Users themselves, who may be controllers of the personal information they access through the Service.

Accessibility: This Privacy Policy uses industry-standard technologies and was developed in connection with the World Wide Web Consortium's Web Content Accessibility Guidelines.

b. Non-Identifying Information and De-Identified Information

  • Non-Identifying Information/Usernames: We also may collect other information that does not identify you directly, such as zip codes, demographic data, information about your use of the Service, and general project-related data (“Non-Identifying Information”). We may combine information collected from Earnyway users, whether they are registered or not (“Earnyway Users”). In some cases, we may render Personal Information (generally, email address) into a form of Non-Identifying Information referred to in this Privacy Policy as “Hashed Information.” This is typically accomplished using a mathematical process (commonly known as a hash function) to convert information into code. While the code does not identify you directly, it may be used by Earnyway’s partners to connect your activity and interests.
  • Combination of Personal and Non-Identifying Information: We may combine your Personal Information with Non-Identifying Information, but Earnyway will treat the combined information as Personal Information.
  • De-Identified Information: We may also de-identify or aggregate information and convert it into non-personal information so that it can no longer reasonably be used to identify you (“De-Identified Information”). We may use De-Identified Information for any purposes described in the “We Use Information We Collect” section below. We will maintain and use De-Identified Information in de-identified form. We will not attempt to reidentify the information, except to confirm our de-identification processes or unless required by law.
  • c. Children

    The Service is a general audience and is intended for users 18 and older. We do not knowingly collect Personal Information from anyone younger than age 18. If we become aware that a child younger than 18 has provided us with Personal Information, we will use commercially reasonable efforts to delete such information from our files. If you are the parent or legal guardian of a child younger than age 18 and believe that Earnyway has collected Personal Information from your child, please contact us at: [email protected]

    2. USE OF INFORMATION

    We use information collected through the Service to provide and improve the Service, develop new Services and products, process your requests, prevent fraud, provide you with information and advertising that may interest you, comply with the law, and as otherwise permitted with your consent.

    a. We Use Information We Collect:

    • To provide and improve the Service, complete your transactions, address your inquiries, process your registration, verify the information you provide is valid, and for compliance and internal business purposes.
    • To contact you with administrative communications and Earnyway newsletters, marketing or promotional materials (on behalf of Earnyway), and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please let us know at [email protected]
    • To tailor the content we display to you and offers we may present to you, both on the Service and elsewhere online.
    • To administer and develop our business relationship with you and, if applicable, the corporation or other legal entity you represent.
    • To assess your proposal to perform a project for Earnyway and prepare related governmental and internal statistics reports.
    • To enforce and comply with the law, including to conduct an investigation, to protect the property and rights of Earnyway, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be or to pose a risk of being illegal, fraudulent, unethical or legally actionable activity. We may also use Device Identifiers to identify Earnyway Users.
    • For the purposes disclosed at the time you provide your information, with your consent, and as further described in this Privacy Policy.
    • To Honor Our Contractual Commitments to You. Much of our processing of Personal Information is to meet our contractual obligations to our investors or to take steps at Users' request in anticipation of entering into a contract with them.
    • For Our Legitimate Interests. In many cases, we handle Personal Information because it furthers our legitimate interests in commercial activities, such as the following, in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals:
      • Providing our Site and Service.
      • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
      • Measuring interest and engagement in our Services.
      • Short-term, transient use, such as contextual customization of ads.
      • Improving, upgrading, or enhancing our Services.
      • Developing new products and services.
      • Ensuring internal quality control and safety.
      • Authenticating and verifying individual identities.

    • To Comply with Legal Obligations. We need to use and disclose Personal Information in certain ways to comply with our legal obligations.

    3. CHANGES TO THIS POLICY

    We may change this Privacy Policy. If we make substantial changes, we will provide notice.


    This Privacy Policy is effective as of the date stated at the top of this page. Earnyway may update this Privacy Policy at any time and any changes will be effective upon posting. By accessing or using the Service after we notify you of such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy regularly.

    Key Terms

    Temporary Suspension

    • If you fail to complete 90% of your daily tasks for 3 out of the last 6 days, your account will be suspended.
    • If more than 20% of the daily tasks are rejected for 3 out of the last 6 days, the account will be suspended.
    • If you are absent for 3 days within a week, your account will be suspended.
    • If you stop working for an extended time, your account will be suspended.
    • If you persist in submitting the wrong work every time, your account will be suspended.

    Permanent Ban

    • The account will be permanently banned if you consistently fail to fulfil the job requirements.
    • We maintain a zero-tolerance policy for dishonest/fraudulent practices. Engaging in such behaviour will result in permanent account suspension.
    • Behave professionally, or your account will face permanent suspension.

    Account Status & Manager

    • Your account will undergo daily audits by a manager.
    • You will be introduced to your manager after activating your account (within 5-7 days maximum).
    • Send all communications via email formally to ensure prompt feedback from your manager.
    • You will receive important updates regarding account issues and health updates directly from your manager.

    Salary

    • Your salary will be credited to your earnyway account by the 6th of each month.
    • If you wish to withdraw your salary, please ensure that you do so from your earnyway account by the 10th of the month.
    • Your salary will be transferred to your preferred account by the 15th of the month.

    Salary Deduction

    • If you are absent, 5$ will be deducted for that day.
    • If you fail to submit the attendance form in time, you will be marked as absent and fined 5$.
    • If 20% or more of your daily target work is rejected, you will not get paid for that day.

    Payment made on

    • If at least 80% of the daily task is completed, the day will be counted for payment.

    Works

    Working start

    • You must start work between the 1st and 10th of any month.

    Reject

    • If you do not provide the required data for each keyword, your submission will be rejected. For example: - Address is missing - Total seller sales are missing - Email is missing - Country is missing - Website is missing (if specified) - Website age is missing (if specified) - Phone number is missing (if specified).
    • If you manipulate the data, it will be rejected. Example: False email address - False phone number - False sales - False address - False country - False website - False website age.
    • If a proper screenshot is not provided, the data will be rejected. For example, a full screenshot with the date and URL visible is required.

    Approved

    • All the information must be present as per the specified keywords.

    Attendance

    • Attendance forms must be submitted by noon daily to start work. Otherwise, you will be considered absent.

    Multiple device logins

    • You are not allowed to log in to the account on two devices at the same time.
    • If you attempt to log in on two devices at the same time, your IP will be blocked.

    Payment Guidelines

    How can I get paid from Earnyway?

    The Earnyway payment section is secure and fast. In the withdrawal section of your account, you can view your current balance, available withdrawal amount, requested amount, approved amount, and rejected amount. The minimum withdrawal amount is only $10! You can choose to receive your payment directly in your bank account, through mobile banking, internet banking, or via an online wallet.

    Payout Guideline:

    To receive payment, complete your daily tasks and maintain a task acceptance ratio of at least 80%. Payment is only made for days when you meet or exceed the 80% task acceptance ratio. Incomplete or low-performance days will not be paid. Only approved tasks count towards the 80% acceptance ratio. Payments are not prorated, and you will only be paid for full days that meet the 80% acceptance ratio. Consistently maintain an 80% task acceptance ratio for payment eligibility.

    Payout Guidelines for Suspended Accounts:

    You will still be eligible for a payout if suspended after working for 13 days.

    Payment Eligibility: Suspended users may receive payments if they complete at least 13 days of tasks within an 80% Task Completion.

    Task Completion: Users must maintain an 80% task approval rate every 13 days.

    Daily Requirement: The 80% approval rate must be met daily. If the rate falls below 80% on any day, that day won't count toward the 13-day requirement.

    Calculation of Approval Rate: The approval rate is based on the number of approved tasks compared to the total assigned for that day.

    Suspension Clause: Even if suspended, users are still entitled to payment for work completed before the suspension if the approval rate condition is met.

    Task Review: Tasks must go through the platform's standard approval process, and only approved tasks count toward meeting the 80% threshold.

    Non-Compliance: If the user fails to work for at least 13 days or maintain an 80% approval rate, they may not receive payment for that work period.

    Record of Performance: The platform will monitor your daily task performance to determine if you qualify for payment if you are suspended. You will still receive payment if you are suspended from working for 13 days.
